Stallholder Trading Terms and Conditions
Effective from 11 April 2026
1. Definitions
Market Manager means The Nest Markets operated by Nicole O’Brien.
Stallholder means any individual, business or entity approved to trade at the Event.
Site means Reddall Reserve, Lake Illawarra and any additional approved operational areas.
Event means the scheduled trading day of The Nest Markets.
Council means Shellharbour City Council.
2. Essential Information
The Nest Markets are owned and operated by Nicole O'Brien.

The Nest Markets operate under approvals, permits and conditions issued by Shellharbour City Council.
All Council conditions are mandatory and non-negotiable and must be adhered to at all times.
3. Event Overview
The Nest Markets operate every second Saturday of the month between 9:00am and 3:00pm.
Bump in is strictly between 7:00am and 9:00am. Bump out is between 3:00pm and 4:30pm.
The markets are curated to maximise attendance and stallholder opportunity during peak trading periods including school holidays, Mother's Day, Father's Day and Christmas.
4. Experience and Capability
The Market Manager has extensive experience in delivering high attendance markets and major community activations, including large scale events exceeding tens of thousands of attendees.
All procedures are designed to meet Council expectations, ensure compliance and deliver a safe and professional event environment.
5. Acceptance of Terms
By booking, paying for or attending, stallholders confirm they have read, understood and agree to these Terms and Conditions in full.
Agreement is automatic upon booking and is legally binding and enforceable.
6. Market Authority
The Market Manager retains full authority over site operations, safety, stall allocation, product approval and participation.
All directions issued by Market Management must be followed at all times and are final.
7. Right to Remove
The Market Manager reserves the right to remove any stallholder without refund for breach of these Terms, unsafe behaviour, non-compliance or where required for operational or safety reasons.
8. No Guarantee of Trade
The Nest Markets does not guarantee attendance levels, sales outcomes or profitability.
9. Force Majeure
The Market Manager is not liable for failure to perform obligations due to events outside reasonable control
including weather, natural disasters, government restrictions or emergencies.
10. Stall Sites
Standard stall size is 3m x 3m.
Stallholders must not exceed their allocated footprint.
No stallholder has any entitlement to ongoing placement or specific positioning.
11. Vehicle Access
No vehicles are permitted onsite between 9:00am and 3:00pm.
All vehicles must move at walking pace during bump in and bump out.
Food trucks must not drive on footpaths under any circumstances as per Council requirements.
No parking is permitted onsite. Approximately 240 parking spaces are available surrounding the reserve.
12. Setup and Pack Down
Stallholders must arrive within the designated bump in period and be fully set up before trading commences. No late arrivals without approval.
Pack down must not commence prior to 3:00pm without approval.
All instructions from Market Management must be followed.
13. Weather Policy
The Market Manager will endeavour to make appropriate decisions regarding weather conditions. Notification will be provided within 48 hours where possible.
Final decisions may be made up to 4:00am on event day.
Notification will be via email, SMS where available and social media. Markets will proceed unless conditions are deemed unsafe.
14. Cancellation Policy
If a stallholder cancels within 72 hours of the event, full stall fees are forfeited with no refund or credit. Refunds or rollovers will only apply if the Market Manager cancels the event.
Where the event is cancelled by the organiser, a $25 administration fee will be retained and the balance refunded or credited.
15. Insurance
All stallholders must hold a minimum of $20 million Public and Product Liability Insurance.
Proof must be provided upon request.
16. Electrical
No electrical access is available onsite.
Stallholders must be fully self sufficient.
17. Food Compliance
All food and beverage vendors must hold a valid and current permit issued by Shellharbour City Council.
No exceptions apply. Failure to comply will result in refusal to trade.
18. Alcohol
Alcohol is strictly prohibited. The sale or supply of alcohol is not permitted within this location.
19. Waste Management
Bins are provided for public use only.
Stallholders must remove all waste generated by their stall. Use of bins by stallholders will incur a $20 per bag penalty. Breaches may result in exclusion or permanent removal. Polystyrene and balloons are not permitted.
Stallholders are encouraged to minimise plastic use and adopt sustainable practices.
20. Safety and Risk
Stallholders must ensure their setup is safe and does not create hazards.
No trip hazards, unsecured structures or unsafe equipment are permitted.
21. Emergency Management
The Market Manager has full authority to direct evacuation, cease trading or modify operations in the event of risk.
All directions must be followed immediately.
22. First Aid and Incidents
All incidents must be reported immediately to Market Management.
Serious incidents will be escalated to emergency services.
23. Code of Conduct
All stallholders must behave professionally and respectfully.
Aggressive behaviour, disruption or failure to follow directions will not be tolerated.
24. Slander and Reputation
Stallholders must not make defamatory, misleading or damaging statements regarding The Nest Markets, organisers, Council, media or associated parties.
This applies to past, present and future conduct.
Breaches will result in removal, permanent exclusion and potential legal action.
25. Promotion
Stallholders are encouraged to share official event promotional materials once published to support event attendance and stallholder success.
26. Liability
The Nest Markets accepts no liability for any loss, damage or injury resulting from stallholder participation.
Stallholders accept full responsibility for their operations, products and conduct.
27. Compliance
All stallholders must comply with all applicable laws, regulations and Council requirements at all times.
28. Agreement
By booking a stall, stallholders agree to all Terms and Conditions outlined in this document.
